Right to repair

The Consumer Guarantees (Right to Repair) Amendment Bill now before parliament offers some hope. It builds on the Ministry for the Environment’s 2021 consultation document, “Taking responsibility for our waste”.

The bill seeks to force manufacturers to provide spare parts, repair information, software and tools to consumers for a reasonable period after the sale of goods. But there is still too much doubt about how long those goods and parts should last in the first place.

To give manufacturers and consumers more certainty, establishing minimum product lifespans is essential. This would be defined as the period for which a product can perform its intended function effectively.

Repairs can extend this functional lifespan. So it is also important to factor in a “repairability period” when products can be repaired at the consumer’s expense, beyond the manufacturer’s implied or expressed guarantee. Spare parts, repair information and necessary tools must be made available.

Planned obsolescence can involve integrating components that are likely to fail sooner than the product itself, withholding spare parts, or requiring prohibitive information and proprietary tools for repairs.

Ultimately, it is about maximising profitability, and extends from smartphones and appliances to automobiles and farm machinery. It fosters a throwaway culture, adding to the strain on waste systems and landfills.

In short, although policies to improve broadband access are important, policies that help ensure the availability of low-cost devices are also essential.

But advocates of digital equity are not the only constituent groups concerned with the supply and accessibility of computing devices. Environmental and labor rights activists advocate for policies that extend the lifecycle of existing devices, which can help to minimize e-waste and protect the viability of the repair and refurbishing labor markets, respectively. Making computer repair cheaper and bolstering secondhand and refurbishing markets better ensures that low-income consumers can afford to maintain the devices they already own and that they can purchase devices as needed (Fosdick, 2012; Islam et al., 2021). Extending the life of a device through repair is often a more affordable choice than purchasing a brand-new device (Svensson-Hoglund et al., 2021). Furthermore, optimizing the lifecycle of existing devices helps exert market pressures on manufacturer's pricing of new devices, helping to keep down the cost of brand new devices (Islam et al., 2021; Leclerc & Badami, 2020). Thus, policies championed to reduce e-waste and protect the right-to-repair (R2R) can also enhance digital equity.

Policies that have mutually beneficial outcomes for different sectors have been described as multisolving innovations (Dearing & Lapinski, 2020). Multisolving innovations can broaden the coalition of activists in support of a given policy issue and can be strategically framed to appeal to constituent bases that might otherwise be disinterested or even antagonistic (e.g., framing environmental policies around health outcomes to appeal to conservatives) to an issue.

In exchange for selling them repair parts, Samsung requires independent repair shops to give Samsung the name, contact information, phone identifier, and customer complaint details of everyone who gets their phone repaired at these shops, according to a contract obtained by 404 Media. Stunningly, it also requires these nominally independent shops to “immediately disassemble” any phones that customers have brought them that have been previously repaired with aftermarket or third-party parts and to “immediately notify” Samsung that the customer has used third-party parts.

"Company shall immediately disassemble all products that are created or assembled out of, comprised of, or that contain any Service Parts not purchased from Samsung,” a section of the agreement reads. “And shall immediately notify Samsung in writing of the details and circumstances of any unauthorized use or misappropriation of any Service Part for any purpose other than pursuant to this Agreement. Samsung may terminate this Agreement if these terms are violated."

The contract shows the incredible level of control that Samsung has over “independent” repair shops, which need to sign this agreement to get repair parts from Samsung. Signing this contract does not even make a repair shop an “authorized” repair center, which is a distinction that requires shop owners to jump through even more hoops.

Owners of Spotify's soon-to-be-bricked Car Thing device are begging the company to open-source the gadgets to save some the landfill. Spotify hasn't responded to pleas to salvage the hardware, which was originally intended to connect to car dashboards and auxiliary outlets to enable drivers to listen to and navigate Spotify.

Car Thing came out to limited subscribers in October 2021 before releasing to the general public in February 2022.

In its Q2 2022 earnings report released in July, Spotify revealed that it stopped making Car Things. In a chat with TechCrunch, it cited "several factors, including product demand and supply chain issues." A Spotify rep also told the publication that the devices would continue to “perform as intended,” but that was apparently a temporary situation.

Spotify's announcement has sent some Car Thing owners to online forums to share their disappointment with Spotify and beg the company to open-source the device instead of dooming it for recycling centers at best. As of this writing, there are over 50 posts on the Spotify Community forums showing concern about the discontinuation, with many demanding a refund and/or calling for open-sourcing. There are similar discussions happening elsewhere online, like on Reddit, where users have used phrases like "entirely unnacceptable" to describe the news.

A Spotify Community member going by AaronMickDee, for example, said:

"I'd rather not just dispose of the device. I think there is a community that would love the idea of having a device we can customize and use for other uses other than a song playback device.

"Would Spotify be willing to maybe unlock the system and allow users to write/flash 3rd party firmware to the device?"

A Spotify spokesperson declined to answer Ars' questions about why Car Thing isn't being open-sourced and concerns around e-waste and wasted money.
